Heat is the leading cause of weather-related worker deaths, and it's almost entirely preventable. The tricky part for employers is that, at the federal level, heat sits in an unusual place: there's no single comprehensive OSHA standard for it — yet the obligation to protect workers is very real. Here's how that works.
No specific standard doesn't mean no duty
OSHA does not currently have a comprehensive federal standard dedicated to workplace heat. It does, however, enforce heat hazards two ways:
- The General Duty Clause — Section 5(a)(1) of the OSH Act requires employers to provide a workplace "free from recognized hazards" likely to cause death or serious harm. Excessive heat is a recognized hazard, and OSHA has cited employers under the General Duty Clause for failing to protect workers from it.
- A National Emphasis Program on heat — OSHA has directed inspection resources specifically at heat hazards in indoor and outdoor work, meaning heat-related complaints and high-heat days can draw enforcement attention.
A federal heat-specific rule has been working through the rulemaking process, and several states run their own heat standards (California, Oregon, Washington, and others) with specific triggers and requirements. So depending on where you operate, you may already be under a formal standard — and even where you aren't, the General Duty Clause applies.
The program that actually prevents heat illness
Whether or not a standard names it, the protective measures are well established and cheap relative to the risk:
- Water, rest, and shade — accessible cool water, rest breaks, and shaded or cooled areas, scaled up as the heat index climbs.
- Acclimatization — new and returning workers build heat tolerance over about a week. A large share of heat fatalities happen in a worker's first few days on the job, before they're acclimatized. Ramp exposure gradually.
- A heat action plan with triggers — defined actions at defined heat-index thresholds (more breaks, buddy checks, work/rest cycles, and stopping work when it's dangerous).
- Training and recognition — workers and supervisors who can spot the early signs of heat exhaustion before it becomes heat stroke.
- Emergency response — knowing what to do, fast, when someone goes down; heat stroke is a medical emergency measured in minutes.
Where the gaps hide
Heat programs fail on the operational edges: the new hire who wasn't acclimatized, the high-heat day where the escalation triggers were never actually pulled, the toolbox talk that didn't happen, the incident where no one recorded the response. Those are workflow and record gaps — not knowledge gaps.
